Tokyo declines to allot additional slot to Paralympian shooter, SC told

New Delhi, Aug 3 (SocialNews.XYZ) The Supreme Court was informed on Tuesday that Tokyo Paralympic organisers have declined to allocate an additional slot for Paralympian shooter Naresh Kumar Sharma.

On Monday, the top court had issued direction to the Paralympics Committee of India (PCI) to include him as an additional participant for the upcoming Paralympics in Japan.

 

Senior advocate Vikas Singh, representing Sharma, submitted before the top court that it is a classic case as Tokyo has declined to allot an additional slot to his client, and added there were 10 slots - eight for men and two for women participants.

He submitted his client's appeal pending before a division bench of the Delhi High Court could be heard on Wednesday, and it be decided whether his client or the other player should go.

A bench of Justices A.M. Khanwilkar and Sanjiv Khanna granted liberty to Sharma to move the Delhi High Court and request it to take up his plea challenging the single-judge order, which declined to interfere in his non-selection for Tokyo Paralympics.

The top court, in its order, said it is disposing of this petition with liberty to the petitioner to approach the division bench of the high court and request for taking up the appeal expeditiously

On Monday, the top court had ordered the PCI to immediately Sharma as an additional participant for the upcoming Paralympics in Japan, which is scheduled to commence from August 24.

Sharma had moved the Delhi High Court, through advocate Satyam Singh, challenging his exclusion from the international event meant for physically challenged participants. The high court had observed that there was arbitrariness in the committee's decision, but, it did not pass immediate orders for his inclusion on the list.

Posting the hearing on his plea on August 6, the high court had directed the Sports Authority of India and the Union Ministry of Youth and Sport Affairs to examine his non-selection.

Sharma filed a plea in the top court, filed through advocates Varun Singh and Nitin Saluja, challenging the high court order.

"The petitioner humbly seeks intervention of this court in the present matter as the legitimate opportunity of the petitioner to participate in Tokyo Paralympics in R7 event and consequently bring laurels to the country will be lost if the arbitrary, discriminatory and capricious selection of the shooter in R7 event by the selection committee of the PCI is allowed," the plea said.
