S386 Bill To Remove Per Country Limit On Green Cards Passed Senate With An Anti China Measure

S386 Bill that removes per-country limit on Green Cards has finally passed the Senate unanimously. This bill is way different from the bill that is passed in the house. Now it goes to the reconciliation committee and the House and Senate are going to need to agree on the final language.

The house adjourns on December 18th for Christmas break and the bills should be reconciled and passed by both houses before that.

The Senate version that passed has three major changes :

  1. In years 1-9 after implementation, no more than 70% of the Green Cards can go to H1 visa holders & their dependents.
  2. Year 10 onwards, no more than 50% of the Green Cards can go to H1 visa holders & their dependents.
  3. No Chinese national affiliated with the Chinese Military or Chinese Communist Party can enter the United States or be adjusted status, under any category.

Since most Chinese students are forced to join a youth organization affiliated to CCP, Every Chinese kid has an affiliation with CCP. Some immigration lawyers are calling it an anti-China bill and unfair.
