Nirbhaya: Court seeks report on convicts' legal remedies

New Delhi, Nov 28 (SocialNews.XYZ) A Delhi court on Thursday sought a report from the Tihar jail authorities on the current status of the legal remedies being sought by the convicts in the 2012 Nirbhaya gang rape case.

Additional Sessions Judge Satish Arora after passing the directions posted the matter for hearing on Friday. The directions came after Special Public Prosecutor Rajiv Mohan informed the court that the execution warrant was not issued as no curative petition is filed yet.

 

The process under section 413 CrPC hasn't happened yet, Mohan said.

The court was hearing a plea filed by Nirbhaya's parents seeking directions of the court to expedite the procedure to execute the convicts. They had approached the court in December last year with a plea seeking direction to Tihar jail authorities to fast track the procedure to hang all the four convicts.

On October 31, the Tihar Jail administration had issued a notice to the convicts in the case stating the death penalty would be executed in seven days if they don't challenge it through a mercy plea.

In December last year, the parents of Nirbhaya, the 23-year-old paramedic who was gang-raped in December 2012, approached the court to fast-track the procedure to hang all four convicts in the case.

The 23-year-old was brutally gang-raped on December 16, 2012 inside a moving bus in south Delhi by six persons. The victim, who was severely assaulted, was thrown out on the road along with her male friend. She died a fortnight later.

The sheer brutality of the gang-rape shocked the nation and led to tightening of rape laws.

Of the six rapists, one was a juvenile who was sent to a remand home and later let off. One of the convicts committed suicide in jail.
