HC seeks DU's response on Sunny Chillar's plea against Ankiv Baisoya

New Delhi, Nov 26 (IANS) The Delhi High Court on Monday asked Delhi University to make its stand clear on National Students' Union of India's (NSUI) Sunny Chillar's plea seeking action against Ankiv Baisoya, who had used forged certificates for securing admission into the varsity.

Chillar was the presidential candidate in this year's Delhi University Students Union election, losing to the Akhil Bharatiya Vidyarthi Parishad's (ABVP) Baisoya.

Justice Yogesh Khanna sought DU's response on the plea, observing that there was nothing on record filed by the university after he had reserved his judgement in the matter last week.

The court has posted the matter for further hearing on December 4.

The court is hearing Chillar's plea seeking a fresh DUSU election under an independent election officer or an appropriate authority "of impeccable character and integrity".

Baisoya, of the Department of Buddhist Studies, defeated Sunny Chhillar of Shivaji College by a margin of 1,724 votes on September 12.

On November 14, the university expelled Baisoya for submitting fake documents from Thiruvalluvar University at Vellore in Tamil Nadu to secure admission in the university.

On November 15, Baisoya in a Facebook post said he was resigning from his post. The ABVP, too, suspended him.

Additional Solicitor General Pinky Anand told the court that if any major office-bearer's post falls vacant only two months after the elections, the Vice President may be promoted to the post of President, as per the recommendations of the Lyngdoh Committee.

The Lyngdoh Committee says that in the event of the office of any major post of office-bearer falling vacant within two months of elections, re-elections should be conducted. Otherwise, the Vice President may be promoted to the post of President and Joint Secretary to the post of Secretary, as the case may be.

The ABVP had won the posts of President, Vice President and Joint Secretary in this year's DUSU election.
