Don't dismiss matters at admission stage without hearing arguments, AG urges CJI

New Delhi, Nov 12 (IANS) Attorney General K.K.Venugopal on Monday urged the Supreme Court Chief Justice Ranjan Gogoi not to dismiss petitions at the stage of admission without hearing the arguments by the lawyers appearing in the cases.

Appearing for the Central government in a tax matter, Attorney General Venugopal told CJI Gogoi: "You will not dismiss it without hearing me. You shall hear me."

 

Sharing the bench with CJI Gogoi was Justice Sanjay Kishan Kaul.

"Your Lordship simply saying 'dismissed' without giving a hearing does not do justice," Venugopal said making his complaint.

"No other court dismisses a case at admission stage without allowing a party to argue," the AG said pointing out: "People come to this court from very far off places for... they will be watching their counsel for hearing and your Lordship without hearing decide it."

It is not doing justice at all, the AG told the CJI.

Asking Attorney General to argue his taxation matter, CJI Gogoi said: "Any way, we take your comments in proper spirit."

Chief Justice Gogoi is known for coming to court prepared after reading the case files and often he also comes prepared with the questions to be asked to the lawyers appearing in the case. He is also known for his time management.
