SC reserves order on plea for specialised benches, composition of benchesNew Delhi, April 9 (IANS) The Supreme Court on Monday reserved its order on a plea seeking the framing of Rules for constituting benches including the composition of constitution benches and the creation of subject centric benches.

The bench of Chief Justice Dipak Misra, Justice A.M.Khanweilkar and Justice D.Y.Chandrachud reserved the order on a plea that a five judge constitution bench should either have five senior-most judges of the top court or three senior most judges and two junior most judges.

Petitioner, lawyer Asok Pande has also sought that the three judge bench in the Chief Justice's court should consist of the Chief Justice and two senior most judges of the court.

 

Seeking the framing of Rules to regulate the composition of benches, he said that this would regulate the unfettered powers being exercised by the Chief Justice in the formation of benches.

Pande has also sought setting up of subject specific benches to exclusively deal with the cases of taxation, service matters, land disputes, social issues and other subjects.

He has also sought direction to Allahabad High Court to frame Rules for setting up of the benches and vesting case specific jurisdiction on the patterns he has sought to be put in place by the top court.
