Notice to ex-JCO due to mistaken identity: Assam DGP

Guwahati, Oct 3 (IANS) The notice served on retired Indian Army JCO M. Azmal Haque by the Assam Police regarding his citizenship was due to "mistaken identity" and was not intended to be served on him, state DGP Mukesh Sahay said on Tuesday.

He said the notice issued by the Foreigners' Tribunal number 2 was in fact intended to be served on M. Azmal Haque, son of Lt Maqbool Ali and resident of Kalahikhas village under Boko police station in Kamrup (Rural) district of Assam.

"This man's wife is named Mazrul Bibi. The couple has two sons -- Majribur Ali and Aabur Ali and daughter Asmina Khatun," the Director General of Police told the media here.

"It appears that the notice was served on the Junior Commissioned Officer M. Azmal Haque, son of Makbul Hussain and whose wife is named Momtaz Khanam. His son's name is Elias Hoque and daughter Shadida Yasim," the officer said, adding "it is a clear case of mistaken identity due to similarity of the two names".

The matter has since been looked into by the Director General of Police (Border) and the Kamrup Superintendent of Police, he said.

Sahay said the police initially failed to serve the Foreigners' Tribunal's notice in its first attempt and returned it to Boko police station.

"However, the retired JCO, on his own, collected the notice from the police station through his brother despite the Boko police suggesting that the notice was 'perhaps' not meant for him," the officer said.

Assam Chief Minister Sarbananda Sonowal has directed the DGP (Border) and Kamrup SP for expeditious probe into the matter and fixing of accountability for lapses, if any, within a week.
