Court nod to file plea against probe into Jayalalithaa's death

Chennai, Oct 3 (IANS) The Madras High Court on Wednesday gave the nod for filing an objection plea against the one-man Commission of Inquiry formed to probe then Chief Minister J. Jayalalithaa's death.

When senior advocate K.M. Vijayan made an appeal to cancel the Commission headed by a former High Court judge, Chief Justice Indira Banerjee and Justice M. Sundar asked him to file a proper petition. It would be taken up for hearing on Wednesday.

 

Vijayan, who represented on behalf of the petitioner and an AIADMK worker, said the Commission should be constituted only after passing a unanimous resolution in the Tamil Nadu Assembly.

"Setting up such commission is totally illegal", he told the court. He said the Commission should be headed by a retired Supreme Court judge.

The Tamil Nadu government on September 25 set up the Commission to investigate Jayalalithaa's death in December and sought a report in three months.
