No relief from HC for Salman Khurshid in DPS Society expulsion

New Delhi, Aug 24 (IANS) The Delhi High Court on Thursday refused to give a y relief to Congress leader Salman Khurshid on his plea seeking interim stay on his expulsion from the membership of Delhi Public School (DPS) Society in 2015.

"The legal right of the plaintiff (Khurshid) to continue to be life member of defendant Society was subject to certain conditions and one was that a life member should not act to the detriment and against the interest of defendant Society," the court said in its order.

 

DPS Society had contended that on March 30, 2015, the former Union Minister, along with Sharda Nayak trespassed the office of the society and she forcibly occupied the office of the Chairman.

"They took control of the premises of the society" and it was in the presence of Khurshid that Nayak announced herself as Chairperson of the society, DPS Society had stated, adding that Khurshid was part of a "well-planned conspiracy to illegally occupy and take over the premises of the society".

Following the incident, an FIR was also lodged against Nayak and Khurshid was served the expulsion notice.

In its order, the court said that "if the plaintiff (Khurshid) despite being a life member of the society supports the person acting against the interest of the society, the only conclusion that can be drawn is that he is acting against the interests of the society.

"The above mentioned facts prima facie show that the plaintiff has been acting against the interests of the society."

Earlier this year, the high court in a trademark infringement suit filed by the Society, had upheld a verdict that had restrained DPS World Foundation from using "DPS" for its operation, saying it was infringing on the registered trademark of the Society.

DPS World Foundation was formed by a group of Delhi Public School alumni including Khurshid and had launched schools in Patna and Greater Noida.
