New Delhi, April 10 (IANS) The Supreme Court will examine whether persons who are disqualified to be the office bearers of the state cricket associations could be their nominees to attend the annual or the special general body meeting of the BCCI.
A bench of Justice Dipak Misra, Justice A.M.Khanwilkar and Justice D.Y.Chandrachud said that they would look into the issue on an application by the Committee of Administrators as bench was told that former BCCI President N. Srinivasan and Secretary Niranjan Shah were attending the meetings ahead of the special general body meeting of the apex cricketing body that will take place this week.
While directing the hearing of the matter on April 17, the bench observed: "If infrastructure is collapseable, it is not conceivable how the super-structur e will come up."
The bench noted the submission by senior counsel C.U. Singh that "whether any one who is not eligible by virtue of his age or other disqualifications that have been postulated by the principal judgment of this court can be nominated by the BCCI to ICC or by the State Associations" and said that this is a matter to be debated.
Singh, who appeared for the Committee of Administrators headed by former CAG Vinod Rai and the CEO of the BCCI, said that the situation that is emerging is that someone may technically not be an office bearer but will pull the strings by virtue of being a nominee of the state associations.
At this, the court said: "If the meeting of the special general body takes place then it would be subject to further adjudication on the prayer or directions sought by the Committee of Administrators."
