New Delhi, Dec 9 (IANS) The Delhi High Court on Friday, while restoring the copyright suit filed by international publishers against sale of photocopied pages of their books at a shop in Delhi University, said it will now decide the issue of the contents of the photocopied course packs and its relevance to the curriculum.
A division bench of Justice Pradeep Nandrajog and Justice Yogesh Khanna directed Rameshwari Photocopy Service in Delhi University's North Campus to maintain records of course packs photocopied and supplied by it and submit six monthly statements to the court.
It allowed the photocopy shop to sell the course packs to students during the time that issues are settled.
The court said that "the utilisation of the copyrighted work would be a fair use to the extent justified for purpose of education".
Restored for trial the suit, it said: "This would warrant an analysis of the course pack with reference to the objective of the course, the course content and the list of suggested readings given by the teacher to the students."
The court's order came on an appeal filed by the three international publishers -- Oxford University Press, Cambridge University Press and Taylor & Francis against the single judge's September 16 order holding that selling of photocopies of portions of books does not amount to infringement of their copyright.
The international publishing giants had alleged that the kiosk was violating their copyright and at the instance of Delhi University, was causing huge financial losses as students stopped buying their text books.
